Credit Servicing Undertaking for
Leon Capital Finance Designated Activity Company
We inform you that on 08.07.2024, doValue Greece Loan and Credit Claim Management Company SA undertook the credit servicing of the debt assigned by Eurobank SA to special purpose vehicle (SPV) “LEON CAPITAL FINANCE DESIGNATED ACTIVITY COMPANY”, in the context of securitisation.
Specifically, in accordance with the provisions of Articles 10 and 14(13) of Law 3156/2003 on “Bond loans, securitisation of claims and claims from real estate and other provisions”, on 8 July 2024 (hereinafter “Transfer Date”), Eurobank SA (hereinafter “Eurobank”), due to securitisation, transferred all its claims from all types of loans and/or debt (hereinafter “Securitisation”) to the company with the corporate name “LEON CAPITAL FINANCE DESIGNATED ACTIVITY COMPANY”, registered in the Republic of Ireland (Denzille Lane, Dublin 2, Ireland, 2nd floor, Palmerston House), with company registration number 761305 (hereinafter “New Beneficiary”). A summary of the relevant transfer agreement has been registered in the Public Register of Article 3 of Law 2844/2000 of the Athens Pledge Registry under agreement publication document registration act no. 492/08.07.2024 of Article 10(8) of Law 3156/2003 (Volume 18, No. 171). As a result of the above, as of the Transfer Date, the New Beneficiary became the beneficiary of all claims stemming from the aforementioned loans and/or debt (including any guarantees, collateral and any other spillover rights) and shall exercise all relevant rights henceforth.
Moreover, upon acquiring the aforementioned claims, the New Beneficiary assigned their servicing to doValue Greece Loan and Credit Claim Management Company SA, in accordance with the provisions of Law 5072/2023 (hereinafter the “Servicer”). A summary of the relevant servicing agreement was registered in the Public Register of Article 3 of Law 2844/2000 of the Athens Pledge Registry under business credit servicing agreement publication document registration act no. 493/08.07.2024 of Article 10(14 & 16) of Law 3156/2003 (Volume 18, No. 172) on the Transfer Date.
As a result of the Securitisation, the personal data of natural persons linked to the claims under any capacity (for example: borrowers/creditors, debtors, co-debtors, guarantors, third-party collateral offerers, special or universal successors of the above and/or natural persons potentially associated with the above, such as legal entity partners or their legal representatives, shareholders and true beneficiaries of legal persons or entities, proxies, representatives, employees/associates, family members, lawyers or procedural representatives of the above, notaries, bailiffs, as well as people against whom the SPV is entitled to collect the claims, e.g. third parties against whom seizure or the right of offset may be imposed) (hereinafter “Data Subjects”), were transferred from Eurobank to the Servicer, by order and on behalf of the New Beneficiary, so that it may process them exclusively for the purpose of credit servicing.
As of the Transfer Date, and for as long as the beneficiary of the claims is the New Beneficiary, the Servicer shall process the personal data of the Data Subjects, acting as an independent data controller, specifying independently from the New Beneficiary the purposes for and means of personal data processing. All relevant information on the processing of personal data by the Servicer (such as personal data categories, sources, purpose and legal basis for processing, rights for the protection of personal data, recipient categories, period kept, etc.), is described in the document entitled “Personal Data Processing Notice pursuant to Regulation (EU) 2016/679 and the relevant Greek legislation” of the Servicer.
To the extent that the New Beneficiary proceeds with personal data processing, all relevant information (such as personal data categories, sources, purpose and legal basis for processing, rights for the protection of personal data, recipient categories, period kept, etc.).
